كما تنص المادة 8 من التعليمات على أنه "إذا قدمت شكوى ضد أحد مأموري الضبط القضائي لإخلاله بواجبات وظيفته أو تقصير في عمله، فعلى عضو النيابة إذا رأى جدية الشكوى أن يستطلع رأي رئيس النيابة كتابة وعلى رؤساء النيابة الرجوع إلى المحامين العامين إذا كانت للشكوى أهمية خاصة وللمحامين العامين بدورهم الرجوع إلى النائب العام". كما تنص المادة 9 على أنه "على أعضاء النيابة، أن يحققوا بأنفسهم في الشكاوى التي تقدم ضد مأموري الضبط القضائي ولا يجوز لهم الندب في تحقيقها".
