  وكما طلبت اللجنة الفرعية في مقررها 1996/119، صاغ السيد جوانيه مجموعة من المبادئ المتعلقة بحماية حقوق الإنسان وتعزيزها من خلال مكافحة الإفلات من العقاب ذكر فيها أنه “لا يمكن تحقيق مصالحة عادلة ودائمة إلا بالظفر بحل فعال يقتضيه العدل” وأن “من الضروري اعتماد تدابير وطنية ودولية … كي تضمن لضحايا انتهاكات حقوق الإنسان في آن واحد المراعاة الفعلية للحق في المعرفة الذي يشمل الحق في معرفة الحقيقة والحق في العدل والحق في التعويض، وهي حقوق لا يوجد في غيابها علاج فعال ضد الآثار المشؤومة للإفلات من العقاب”.
