  في المقابل اعتبر الوصف التالي ذكره لحالات عدم المطابقة غير مستوف للشرط الوارد في المادة 39(1)، لعدم كفاية نسبة التحديد : إشعار بأن حجارة الواجهة الأمامية لأحد المباني غير موسومة وأن بعض الحجارة والعتبات ليست بالحجم المناسب وأن الغراء اللاصق المستخدم لرصف الحجارة فيه خلل، غير أن هذا الإشعار لم يحدد الحجارة التي لم توسم، وكمية ونوع المواد ذات الحجم غير المناسب والكمية الدقيقة للحجارة المعالجة بواسطة الغراء الفاسد؛ إشعار بأن النبتات المزهرة كانت في وضع يرثى له ولم تنمو كما يجب (لاحظت المحكمة أن المقصود بالنمو هنا قد يكون إما نمو النبتة من حيث الحجم أو نموها من حيث الشكل والمظهر)؛ إشعار بأن نوعية القماش القطني سيئة ؛ إشعار بأن الأُثاث يتضمن قطعا غير مناسبة وقدرا كبيرا من الكسر؛ إشعار بأن الأزياء رديئة الصنعة وغير منطبقة على مقاييس الجسم ؛ إشعار لم يحدد بأن الجبن يحتوي على كميات هائلة من اليرقات؛ إشعار بأن نوعية القماش رديئة وبأن مقاييس القماش المسلّم لا تسمح بقصّه بشكل اقتصادي، إنما لم يذكر هذا الإشعار طبيعة المشاكل النوعية ولم يلحظ المقاييس التي من شأنها السماح بتفصيل القماش بشكل اقتصادي؛ إشعار بأن الآلة الزراعية لم تعمل بالشكل اللازم، إنما لم يحدد الإشعار الرقم التسلسلي للآلة أو تاريخ تسليمها؛ إشعار بأن الكمأ اصبح ليّنا وطريّا في حين أنه كان في الواقع يحتوي على ديدان، على الرغم من أن معظم الباعة المحترفين يدركون أن اللين هو علامة تفيد بوجود ديدان في الكمأ ؛ إشعار بأن الأحذية ليست بالنوعية المنصوص عليها في العقد، غير أنه لم يصف طبيعة هذه العيوب؛ إشعار بأن لحم الخنزير المقدد والمجلّد فاسد، إنما لم يجر تحديد ما إذا كان كل اللحم فاسدا أم جزء منه فقط؛ إشعار بأن الوثائق المتعلقة بآلة طباعة مفقودة، إنما كان هناك لغط إذ لم يُفهم ما إذا كان المشتري يقصد كامل جهاز الطباعة أم مجرّد مكوّن من مكوّناته ؛ إشعار بأن صفائح المطاط المفلكن المستخدم لصناعة نعال الأحذية تشوبه العيوب؛ إشعار يفيد بأن البضائع الجلدية غير مطابقة للمواصفات التي حددها المشتري ولا يمكن بيعها لزبائن المشتري، وأن 250 قطعة منها مدموغة بشكل سيء؛ إشعار بأن خمس لفّات من البطانيات مفقودة، غير أن هذا الإشعار لم يحدد تصميم البطانيات المفقودة ما لم يسمح بالتالي للبائع باتخاذ التدابير العلاجية.
